Orders

It is up to the buyer to select the products he wishes to order on the site, by adding them to his basket. The order must then be confirmed by the buyer when he pays for his order by completing the various steps. The sale will only be considered final after the seller has sent the buyer confirmation of the acceptance of the order, indicating that the payment made by the buyer has been received and that the seller guarantees the availability of the products.

A payment confirmation email will be sent to the buyer at the same time. Acceptance of the order is therefore subject to the availability of the products and payment by the buyer, and will only be effective after full payment has been received. The buyer can track the progress of their order at any time on the seller's website in the MY ACCOUNT section, then MY ORDERS.

Rates

The products are supplied and delivered at the prices in effect on the day of confirmation of acceptance of the order by the seller and as communicated to the buyer prior to placing the order.

A confirmation of payment of the order is established by the seller and sent by email to the buyer once the amount of the order has been paid online.

The seller may modify its prices at any time and without notice.

VI- PAYMENT CONDITIONS
Payment deadlines

The price is payable in cash, in full on the day the order is placed by the buyer, according to the terms specified in the article relating to Orders. The seller will not be required to deliver the products ordered by the buyer if the price has not been previously paid in full (price including tax and delivery costs including tax).

Payment terms

Regardless of the method of payment chosen by the buyer, payment of the order will only be considered final after actual collection of the amounts due to the seller. Payment for purchases is made in Euros by Bank Card via a secure payment system (Carte Bleue, Visa, Mastercard) or by bank check issued by a bank domiciled in France to the order of SARL SODIWINE.

In the event of payment by bank check, this will be released for collection upon receipt.

Delivery of the order

If all or part of the delivery addresses prove to be incorrect, forcing the seller to return the orders to its warehouse, it is up to the buyer to bear all the consequences (delay in delivery, possible repercussions on the cost of transport, etc.).

VII- DELIVERIES

The seller delivers exclusively to METROPOLITAN FRANCE. The products purchased will be delivered within an average of four (4) to six (6) working days from the placing of the order.

Only the buyer's signature confirms the reality of delivery.

The buyer is required to check the condition and conformity of the products delivered upon delivery. He can then either accept the order if it appears to be compliant by issuing reservations on the delivery note if necessary, or refuse the order if the order is clearly non-compliant (stained or broken bottles for example, etc.). In the event of a lack of conformity, the seller will assume the return costs and replace the product as soon as possible at his own expense. If the product cannot be replaced, the buyer will be reimbursed.

VIII- TRANSFER OF OWNERSHIP AND TRANSFER OF RISKS

The products travel at the seller's risk. The transfer of risks of loss and deterioration of the products will be carried out when the buyer signs the delivery note.

VIX- RIGHT OF WITHDRAWAL

The buyer has, in accordance with the law and without having to provide reasons or pay penalties, a withdrawal period of seven (7) clear days from the delivery of the products to return them to the seller at the address of its head office for exchange or refund, provided that the products are returned in their original packaging and in perfect condition within eight (8) days of delivery. The sums paid by the buyer, including delivery costs, will be fully refunded by bank transfer to the account indicated for this purpose by the buyer or by bank check within a maximum period of one (1) to three (3) weeks which begins to run from the exercise of the right of withdrawal. The costs incurred by the seller by the return may nevertheless be charged to the buyer on the basis of the delivery costs invoiced when ordering.

XI- PROTECTION OF MINORS

In accordance with Article L. 3342-1 of the Public Health Code applicable to sites selling alcoholic beverages on the Internet, which provides that the sale of alcohol to minors under the age of eighteen (18) is prohibited, the buyer undertakes to certify that he or she is of legal age by checking the appropriate box when arriving on the website www.ladifference-roussillon.com and when placing an order.

XII- LANGUAGE OF THE CONTRACT AND APPLICABLE LAW

By express agreement between the seller and the buyer, these General Terms and Conditions are governed by and subject to the application of French law. In the event of a dispute, only the French text shall prevail.

XIII- ACCEPTANCE BY THE BUYER

The fact that a natural or legal person places an order on the seller's website implies full and complete adherence to and acceptance of these General Terms and Conditions, which is expressly acknowledged by the buyer, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against the seller. The headings at the top of each article are for ease of reading only and may not under any circumstances be used as a pretext for any interpretation or distortion of the clauses to which they relate.
